This Agreement is entered into by and between **{name}** ("Participant"), born **{dob}**, residing at **{address}**, and **Deep Waters Grappling LLC**, located in Oviedo, Florida (“Gym”), including its owners, instructors, employees, volunteers, agents, and representatives.
**1. Acknowledgment & Assumption of Risk**
I acknowledge that participation in Brazilian Jiu-Jitsu (BJJ) involves strenuous physical activity and carries inherent risks, including but not limited to: sprains, fractures, concussions, dislocations, soft tissue injuries, cardiovascular complications, and in rare cases, paralysis or death. I VOLUNTARILY ASSUME FULL RESPONSIBILITY for all risks, known and unknown, even if caused in whole or in part by the negligence of Deep Waters Grappling LLC or its representatives.
**2. Participant’s Physical Condition**
I certify that I am in good physical health and have no medical or mental conditions that would impair my safe participation in BJJ. I understand it is my responsibility to consult with a physician before beginning any training and to disclose any conditions that may increase my risks.
**3. Release of Liability under Florida Law**
In consideration for being permitted to participate, I, for myself, my heirs, executors, administrators, and assigns, hereby RELEASE, WAIVE, AND FOREVER DISCHARGE Deep Waters Grappling LLC and all persons acting on its behalf from any and all claims, demands, actions, or causes of action of any kind arising out of or connected with my participation in training, including those arising from NEGLIGENCE of Deep Waters Grappling LLC or its representatives, to the fullest extent permitted by Florida law.
**4. Indemnification**
I agree to INDEMNIFY AND HOLD HARMLESS Deep Waters Grappling LLC and its representatives against any loss, liability, damage, or cost they may incur arising out of or related to my participation, including attorney’s fees and legal costs.
**5. Photography & Media Release**
I grant Deep Waters Grappling LLC permission to capture my likeness, image, and/or voice in photographs, videos, or other media for promotional or educational purposes, without compensation. I waive any right to approve or inspect such usage.
**6. Governing Law & Venue**
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes shall be brought exclusively in the state courts of Seminole County, Florida, and I consent to the jurisdiction of those courts.
**7. Severability**
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full effect.
**8. Acknowledgment of Understanding**
I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY. I ACKNOWLEDGE THAT BY SIGNING, I AM GIVING UP LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE, TO THE MAXIMUM EXTENT PERMITTED BY FLORIDA LAW.
